1. Acceptance of Terms

By creating an account, purchasing a paid feature, or accessing or using ThePocketBoss (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not access or use the Service.

2. Description of Service

ThePocketBoss is a business management platform designed for contractors and service-based businesses. The Service includes features for:

  • Inventory and equipment management
  • Scheduling and appointment booking
  • Invoicing and estimates
  • Customer relationship management (CRM)
  • Project tracking and management
  • Payment processing via Stripe Connect
  • SMS notifications and reminders
  • Optional AI-assisted telephone intake and follow-up

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete registration information
  • Notifying us immediately of any unauthorized use of your account

4. Subscription and Billing

ThePocketBoss offers subscription-based access to the Service:

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • We reserve the right to change pricing with 30 days' notice

4.1 AI Receptionist Billing

  • AI Receptionist is an optional service governed by these Terms and the pricing disclosed before checkout.
  • The managed telephone number is a separate recurring subscription at the price shown before checkout, currently $5 per month. AI call usage is not included in that fee or in the core PocketBoss subscription.
  • Calls use prepaid AI credit. Before purchase, PocketBoss displays the usable credit, disclosed reload fee, checkout total, estimated talk time, refund policy, and policy version.
  • Purchased AI credits are generally non-refundable except where required by law or expressly approved by PocketBoss. Credits are not cash, cannot be transferred, and may be used only for eligible AI Receptionist call usage.
  • Talk-time and per-minute figures are estimates, not guaranteed rates. Actual deductions may vary with call duration, provider charges, rounding, and other usage factors. PocketBoss may reserve an estimated call cost before a call and finalize it after provider usage arrives.
  • Canceling the managed number stops its billing and call routing, may permanently release the number, and does not create a refund for previously purchased AI credit.

5. Payment Processing

If you use our payment processing features powered by Stripe Connect:

  • You agree to Stripe's Connected Account Agreement
  • Platform fees apply to transactions processed through our Service
  • You are responsible for compliance with all applicable payment card industry regulations
  • ThePocketBoss is not liable for disputes between you and your customers

6. SMS and Communication Services

When using our SMS notification features:

  • You must obtain proper consent from recipients before sending messages
  • You agree to comply with all applicable telecommunications laws (TCPA, CAN-SPAM, etc.)
  • You are solely responsible for the content of messages sent through our platform
  • Message and data rates may apply to recipients
  • We reserve the right to suspend SMS services for violations of these terms

6.1 AI-Assisted Calls

  • AI Receptionist identifies itself as an AI receptionist. You may not instruct it to impersonate a human or conceal that disclosure.
  • You are responsible for configuring call forwarding and using AI-assisted calls in compliance with applicable consent, privacy, recording, telemarketing, accessibility, and telecommunications laws.
  • AI-generated summaries, caller matches, urgency labels, and intake details may be incomplete or incorrect. You are responsible for reviewing follow-up and confirming material information with the caller.
  • AI Receptionist is not an emergency service, dispatch center, medical provider, legal adviser, or substitute for calling 911 or another appropriate emergency service.
  • The service depends on third-party providers, including Stripe, Twilio, and Retell. Provider outages, restrictions, pricing changes, or technical failures may delay, interrupt, reject, or end calls.
  • PocketBoss may pause or reject calls when prepaid credit is insufficient, billing is inactive, routing is disabled, or safety and fraud controls require it.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Send spam, unsolicited messages, or harassing communications
  • Transmit malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use the Service for any fraudulent or illegal purpose

8. Intellectual Property

The Service and its original content, features, and functionality are owned by ThePocketBoss and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any data or content you upload to the Service. By uploading content, you grant us a limited license to use, store, and display that content solely for the purpose of providing the Service to you.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, disclose, and retain information and is a notice, not a contract.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEPOCKETBOSS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or similar issues transmitted through the Service

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO THEPOCKETBOSS FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless ThePocketBoss and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Upon termination, your right to use the Service will immediately cease. You may export your data before termination through your account settings.

Ending your core PocketBoss subscription does not guarantee preservation of an AI Receptionist telephone number. You are responsible for disabling forwarding, and any managed number may be released and permanently lost when the applicable phone service is canceled or terminated.

14. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. Proceedings must be brought in a court with jurisdiction in Tennessee unless applicable law requires another forum.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide advance notice through the Service, by email, or by another reasonable method. Changes apply prospectively from the stated effective date.

16. Entire Agreement and Severability

These Terms, the Privacy Policy, and any product-specific terms presented at purchase are the entire agreement regarding the Service and supersede earlier online terms on the same subject. Product-specific terms control only for the feature or transaction they address. If a provision is unenforceable, the remaining provisions remain in effect.
